Congress created the EB-5 Immigrant Investor Program to stimulate the U.S. economy. The program allows foreign investors to visit the United States for a limited time if they have the intention and means to invest in new businesses. There are 10,000 visas available annually and the application process is complex. But qualified applicants will have an opportunity to legally stay here as a permanent resident while creating jobs.
In order to qualify for the EB-5 program, you must invest in a new or existing business that will generate 10 new jobs within two years, either directly or indirectly depending on your investment. These jobs may be direct or indirect. A direct job is one that results from the investor’s capital. An indirect job is one that results collaterally because of the capital invested.
In order to qualify, you will have to invest $1 million or more of your own money. Some capital investors are allowed to avoid this requirement by investing at least $500,000 in a high-unemployment area or rural area. Qualifying areas must have an unemployment rate that is over 150 percent of the national average or a boundary that is outside a town or city that has a population of 20,000 or more.
The application process for obtaining an EB-5 is complicated. Anyone interested in joining the select few who qualify in the coming fiscal year would be well advised to employ legal guidance. This is a growing program that benefits investors, as well as the United States, but the application process can prove stressful for those who are new to the system.
